UPDATE: Arkansas AG won't appeal Johnson's stay of execution

LITTLE ROCK - UPDATE: Arkansas Attorney General Leslie Rutldege says at this time she won't appeal Stacey Johnson's stay of execution to the U.S. Supreme Court. 

 

Johnson was scheduled to be executed tonight for killing Carol Heath in 1993 in Sevier County, AR.

The Arkansas Supreme Court has granted a stay of execution for one of the executions set for Thursday.

Stacey Johnson was convicted of killing Carol Heath  in 1993 in Sevier County, AR.

Johnson is claiming DNA evidence can show he didn't kill Heath.

In a 4-3 ruling late Wednesday afternoon, the state's highest court issued a stay for Johnson and ordered a new hearing in lower court for Johnson to make his claims.               

Johnson was set for execution Thursday night along with Ledell Lee.
