Man accused of impregnating 15-year-old in AR, charged with sexual assault

A Tennessee man has been arrested after allegedly impregnating a 15-year-old girl in Arkansas.

Cristobal Reyes-Perez, 31, of Memphis, was arrested Monday after being interviewed by police.

According to a Russellville Police Department news release, authorities were called to the home of the alleged victim on a report of rape.

After arriving, the mother of the victim told officials that her daughter had become pregnant by Reyes-Perez. The mom went on to tell police that he met the teen online.

Russellville Police do say that the incident was consensual.

Reyes-Perez is charged with Internet Stalking of a Child and Sexual Assault in the 4th Degree. He is being held on $50,000 bond.

Police say Reyes-Perez is not charged with Statutory Rape because the sex was consensual.

The statute for Sexual Assault in the 4th Degree ACA 5-14-127 reads: a person commits if they are 20 years of age or older and engage in deviate sexual activity or intercourse with another person who is less than 16 years of age.

Reyes-Perez is charged with a felony offense because they allegedly had intercourse. It would be downgraded to a misdemeanor if they had engaged in sexual contact other than intercourse.

Police say since there was no force or compulsion in this case, the statute for Rape doesn’t fit.
